The Customer agrees that these terms and conditions shall be deemed to apply when the Customer avails the Planet Dreamz Taxi service provided by the Company.

The Company provides technology based services for booking taxis on Madhya Pradesh basis to you and you agree to obtain taxi services offered by third party taxi providers, drivers or vehicle operators ("the Service Provider"). All the Services provided by the Company to you by means of your use of the booking platform are hereinafter referred to as the "Service."

www.madhyapradeshholiday.com, www.bhopaltaxi.com, www.indoretaxi.com etc. are websites operated by Planet Dreamz Services Pvt. Ltd., a company incorporated under the Company's Act. PLANET DREAMZ SERVICES PRIVATE LIMITED is herein after for the purpose of Terms & Condition will be referred as PLANET DREAMZ SERVICES PRIVATE LIMITED.

  A) The Customer shall pay Taxi fare as informed by the call centre or as per the fare charged as available in Planet Dreamz Services Pvt. Ltd. The customer shall pay the taxi fare (as displayed in the meter), parking charges, additional night surcharge (where applicable) and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the taxi services. The toll charges will be payable by customer as applicable, only when the customer is travelling in PLANET DREAMZ SERVICES PRIVATE LIMITED cab & crosses the toll post.

B) The fare range displayed in the ‘Fare Estimation’ provided in the Planet Dreamz Mobile App is an estimate. The actual fare payable will be displayed in the billing device / meter installed in the cab. The Company takes no responsibility for the accuracy of the estimates and any variation between the estimate and the actual fare.

C) The Customer agrees and acknowledges that the use of the services offered by PLANET DREAMZ SERVICES PRIVATE LIMITED is at the sole risk of the Customer and that PLANET DREAMZ SERVICES PRIVATE LIMITED disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.

D) Without prejudice to the above, PLANET DREAMZ SERVICES PRIVATE LIMITED makes no representation or warranty that:

• The service will meet your requirements.
• The service will be uninterrupted, timely, secure, or error-free.

E) The Customer shall ensure that he/she will not indulge in any of the following activities while in a taxi:

• Smoking or consuming any kind of intoxicants inside the Taxi. The Driver has the right to refuse the pick-up or ask the customer to alight the cab if the customer is found to be in an intoxicated state or is found misbehaving with other passengers or the Driver.
• Littering the Taxi
• Soiling or damaging the seats and/or any other interiors of the Taxi.
• Misusing, soiling or damaging any of the devices (technical/non-technical) in the taxi.
• Asking the Driver to break any Traffic/RTO/City Police and/or government rules for any purpose (especially reaching the destination earlier). The Driver has the right to refuse such a request by the customer. The Driver also has the right to refuse such a pick-up or ask such customer(s) to alight the cab.
• Asking the Driver to board more than its pre defined capacity in the taxi. The rules under which the taxi services are provided by the Company, stipulate that a maximum of its passenger capacity shall be allowed per trip. In view of this, the customer shall not pressurize the Driver to allow more than its capacity passengers in the taxi. The Driver has the right to refuse such a pick-up or ask such customer(s) to alight the cab.
• Pressurizing the Driver to overload the boot space of the taxi with luggage. The customer shall not be allowed to use the seating area of the taxi for placing any kind of luggage.
• Arrive more than 15mins late from the stipulated pick-up time. In case of any emergency(ies), the customer can co-ordinate with the Contact Centre and amend the booking. The customer at no point in time will pressurize the Driver to wait for him/her beyond 15mins of the stipulated pick-up time.

F) PLANET DREAMZ SERVICES PRIVATE LIMITED shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of taxi service offered by PLANET DREAMZ SERVICES PRIVATE LIMITED or due to the failure of PLANET DREAMZ SERVICES PRIVATE LIMITED to provide services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of PLANET DREAMZ SERVICES PRIVATE LIMITED or any person or any organization involved in the above mentioned systems.

G) Without prejudice to the above, PLANET DREAMZ SERVICES PRIVATE LIMITED shall not be liable for any direct or indirect loss or damage which may be suffered by the Customer as a result of any failure by PLANET DREAMZ SERVICES PRIVATE LIMITED to provide a taxi to the Customer within any stipulated time even if PLANET DREAMZ SERVICES PRIVATE LIMITED has agreed to so provide the taxi or even if the Customer has advised PLANET DREAMZ SERVICES PRIVATE LIMITED of the possibility that any such loss or damage would result if the taxi is not provided at all or within the stipulated time.

H) The Customer shall indemnify PLANET DREAMZ SERVICES PRIVATE LIMITED from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnify basis) claims, demands, actions and proceedings which PLANET DREAMZ SERVICES PRIVATE LIMITED may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of the Services by the Customer and shall pay such sums on demand.

I) PLANET DREAMZ SERVICES PRIVATE LIMITED is hereby authorized to use the location based information provided by any of the telecommunication companies when the Customer uses the mobile phone to make a taxi booking. The location based information will be used only to facilitate and improve the probability of locating a taxi for the Customer.

J) PLANET DREAMZ SERVICES PRIVATE LIMITED shall be entitled to disclose to all companies within the PLANET DREAMZ SERVICES PRIVATE LIMITED or any of its authorized chauffeurs or any government body as so required by the law or by directive or request from such government body or any third party, the particulars of the Customer in the possession of PLANET DREAMZ SERVICES PRIVATE LIMITED in any way as PLANET DREAMZ SERVICES PRIVATE LIMITED, in its absolute discretion, deems fit or if it considers it in its interests to do so.

K) PLANET DREAMZ SERVICES PRIVATE LIMITED shall be entitled at any time without giving any reason or prior notice to terminate the booking of taxis done by the Customer.

L) PLANET DREAMZ SERVICES PRIVATE LIMITED encourages all its customers to take full responsibility of his/her items. In case of lost items inside the PLANET DREAMZ SERVICES PRIVATE LIMITED Cabs during the journey, PLANET DREAMZ SERVICES PRIVATE LIMITED will try to locate the items on a "best-effort" basis but is not responsible for the same in case of loss or damage to the same.

M) If the Customer leaves any goods in the taxi or has any complaint in respect of the services or the use of the taxi, the Customer has to inform PLANET DREAMZ SERVICES PRIVATE LIMITED of the same in writing within 24hours of using the taxi or the services of PLANET DREAMZ SERVICES PRIVATE LIMITED.

N) The courts of Bhopal, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the services offered by PLANET DREAMZ SERVICES PRIVATE LIMITED or the agreement or arrangement between PLANET DREAMZ SERVICES PRIVATE LIMITED and the Customer.

O) PLANET DREAMZ SERVICES PRIVATE LIMITED shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at PLANET DREAMZ SERVICES PRIVATE LIMITED's website at www.madhyapradeshholiday.com, www.bhopaltaxi.com, www.indoretaxi.com etc or on the date that PLANET DREAMZ SERVICES PRIVATE LIMITED may indicate that such addition, variation or amendment is to come into effect.

P) DISCLAIMER: The Companies website is continuously updated and checked for inaccuracies, omissions and inconsistencies. However, even with the greatest care, inaccuracies, omissions and inconsistencies may occur. The Company does not warrant the accuracy, adequacy or completeness of this information and materials and expressly disclaims liability for errors or omissions in such information and materials. The Company does not represent or warrant that the information and content on this site, or the facilities that make it available, will not cause damage, or are free from any computer virus or any other defects or errors, or that your access to this site will be uninterrupted or that your transmissions will be processed in a timely manner. The Company is not liable for any loss or damage arising from the use of this content and information.

Q) Cancellation Policy: Planet Dreamz believes in helping its customers as far as possible, and has therefore a liberal cancellation policy. Under this policy:

• Greater than 24 hours before scheduled pick up time 25% of the advance you paid will be retained as cancellation fees and the balance 75% refunded.
• 24 - 12 hours before scheduled pick up time 50% of the advance you paid will be retained as cancellation fees and the balance 50% refunded.
• 12 - 4 hours before scheduled pick up time 75% of the advance you paid will be retained as cancellation fees and the balance 25% refunded.
• 04 - 00 hours before scheduled pick up time the advance you paid will be retained as cancellation fees.
• The customer can cancel any booking made through COD option, by simply contacting our call center. The refund amount shall be processed either by an online transfer to the customer's bank account or by a cheque issue in the name of the customer only. No requests for cash refunds will be entertained.

R) All calls made to our call centre are recorded by us for quality and training purposes.

S) All vehicles registered with Planet Dreamz Services Private Limited are continuously tracked using GPS for security reasons only.

T) Planet Dreamz Services Private Limited does not warrant that this site, its servers, or e-mails sent from PLANET DREAMZ SERVICES PRIVATE LIMITED are free of viruses or other harmful components. PLANET DREAMZ SERVICES PRIVATE LIMITED will not be liable for damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
